By accessing or using the Soil Wizards website at soilwizards.com and all associated pages, content, and services (collectively the “Website”), or by scheduling, receiving, or paying for any service provided by Soil Wizards (“Services”), you (“User” or “you”) confirm that you have read, understand, and agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully before using our Website or Services.

These Terms apply to all visitors, clients, and others who access or use the Website or Services. If you are accessing the Website or Services on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Soil Wizards reserves the right to revise and update these Terms at any time without prior notice. The most current version will always be posted on the Website with the updated effective date. Your continued use of the Website or Services following any changes constitutes your acceptance of the revised Terms. If we make material changes, we will make reasonable efforts to notify registered users by email.

 

  1. About Soil Wizards & Our Services

Soil Wizards is a pest control company serving residential and commercial customers throughout Marion County and surrounding areas of Florida. Our Services include, but are not limited to:

  •       Termite Control — inspection, treatment, and prevention of termite infestations
  •       Chinch Bug Control — identification and elimination of chinch bug damage in lawns
  •       Ant Control — targeted treatment for fire ants, carpenter ants, and other ant species
  •       Cockroach Control — interior and exterior cockroach elimination and prevention
  •       Sod Webworm Control — treatment for sod webworm larvae damaging turf grass
  •       Mole Cricket Control — targeted lawn treatments to eliminate mole cricket activity
  •       Spider Control — treatment for venomous and nuisance spider species
  •       Wasp & Hornet Control — safe removal and nest elimination for wasps, hornets, and yellow jackets

All Services are subject to scheduling availability, property assessments, and applicable service agreements entered into between Soil Wizards and the client. Additional services may be offered from time to time; please visit soilwizards.com for the most current list.

 

  1. Age Requirements

The Website and Services are intended for use by individuals who are 18 years of age or older. By accessing the Website or engaging our Services, you represent and warrant that you are at least 18 years old. Any use of the Website by persons under 18 is unauthorized and in violation of these Terms. We may terminate access without notice if we believe a user does not meet this age requirement.

 

  1. Website Use Restrictions

Without our prior written consent, you may not:

  •       Use any automated tools, bots, spiders, scrapers, or scripts to access or collect information from the Website;
  •       Frame or mirror the Website, or use framing techniques to enclose any content or proprietary information;
  •       Engage in screen scraping, database scraping, or any activity intended to extract content or data;
  •       Use the Website in any way that violates applicable local, state, or federal laws or regulations;
  •       Attempt to damage, disable, overburden, or impair the Website or interfere with any other party’s use and enjoyment of it;
  •       Access or monitor the Website for benchmarking, competitive intelligence, or other direct competitive purposes.

Soil Wizards reserves the right to terminate or restrict your access to the Website for any reason, with or without cause, including if we believe you have violated or acted inconsistently with these Terms.

 

  1. Service Scheduling & Cancellations

Scheduling

Service appointments may be requested through the Website, by phone, or through other communication channels. Confirmation of an appointment is subject to availability and approval by Soil Wizards. We will make reasonable efforts to honor scheduled appointments, but reserve the right to reschedule due to weather conditions, equipment availability, or other circumstances beyond our control.

Cancellations & Rescheduling

If you need to cancel or reschedule a scheduled appointment, we ask that you notify us at least 24 hours in advance. Cancellations made less than 24 hours before a scheduled appointment may be subject to a cancellation fee as specified in your service agreement. Soil Wizards reserves the right to cancel or reschedule appointments at any time and will notify you as soon as reasonably possible.

Recurring Service Plans

For clients enrolled in recurring pest control or treatment programs, either party may terminate the plan with written notice as specified in the applicable service agreement. Any prepaid services not yet rendered at the time of cancellation will be refunded on a pro-rated basis unless otherwise specified in the service agreement.

 

  1. Property Access & Client Responsibilities

By scheduling Services, you grant Soil Wizards and its authorized employees and contractors reasonable access to the areas of your property necessary to perform the requested pest control services. You agree to:

  •       Ensure safe and unobstructed access to all treatment areas — including interior rooms, crawl spaces, attic areas, yard perimeters, and known pest entry points — on scheduled service dates;
  •       Notify Soil Wizards in advance of any known hazards, underground utilities, aggressive animals, or areas requiring special care;
  •       Remove or secure pets and keep children away from all treatment areas during service and for the re-entry period specified by our technician following any chemical application;
  •       Follow all post-service instructions provided by Soil Wizards technicians, including re-entry intervals, ventilation requirements, and any restrictions on watering treated areas;
  •       Disclose any known allergies, chemical sensitivities, respiratory conditions, or health concerns of household members or pets that may be relevant to pest control products used;
  •       Inform Soil Wizards of any pre-existing pest conditions, prior treatments, known structural issues, or active infestations that may affect the effectiveness or safety of our services;
  •       Ensure that food, dishes, and food-preparation surfaces are covered or stored away before interior treatments, as directed by our technician.

Soil Wizards is not liable for unsatisfactory results or damage arising from your failure to meet these responsibilities or to follow post-treatment instructions.

 

  1. Payments & Billing

Payment terms for all Services are as set forth in the applicable service quote, invoice, or service agreement. By providing a payment method, you authorize Soil Wizards to charge the applicable fees for Services rendered. All fees are in U.S. dollars.

For recurring service plans, you authorize Soil Wizards to charge your payment method on the billing schedule set forth in your service agreement. You are responsible for keeping your payment information current. Late payments may be subject to interest charges or suspension of Services.

Promotional pricing, discounts, or special offers are valid only for the period and conditions specified. Soil Wizards reserves the right to adjust pricing for ongoing service plans with reasonable advance notice.

 

  1. Service Guarantee

Soil Wizards stands behind the quality of its pest control work. If you are not satisfied with a specific treatment result, please contact us within 7 days of the service date and we will schedule a complimentary follow-up visit to re-treat at no additional charge, subject to the following conditions:

  •       You have followed all post-treatment instructions, including re-entry intervals and restrictions on cleaning or disturbing treated areas;
  •       The re-service request relates to the same pest issue targeted in the original treatment;
  •       Conducive conditions (moisture, entry points, food sources) have not materially changed or been left unaddressed since the original service.

Pest populations and behaviors can vary based on season, weather, property conditions, and the extent of infestation. This guarantee covers re-treatment of the specific issue addressed and does not guarantee complete elimination in a single visit for severe or long-established infestations. Our technician will advise you on realistic expectations at the time of service.

This guarantee does not apply where damage or re-infestation results from conditions outside our control, failure to follow post-treatment care instructions, or where access to the property or treatment areas was restricted.

 

  1. User Account & Information

Certain features of the Website may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as needed.

You agree not to impersonate any person or entity, or falsely state or misrepresent your identity or affiliation with any person or entity. You will notify Soil Wizards promptly of any unauthorized use of your account. Soil Wizards is not responsible for losses resulting from unauthorized use of your account.

 

  1. Intellectual Property

All content on the Website, including but not limited to text, graphics, logos, images, videos, and software (“Soil Wizards Content”), is the property of Soil Wizards or its content suppliers and is protected by applicable intellectual property laws. The “Soil Wizards” name, logo, and related graphics are trademarks of Soil Wizards and may not be used without prior written permission.

No Soil Wizards Content may be modified, copied, distributed, reproduced, republished, downloaded, posted, transmitted, or sold in any form without our prior written permission. You may print or download material from the Website for your personal, non-commercial use only.

Any feedback, comments, suggestions, or other submissions you provide to us (“Submissions”) shall be non-confidential and become the sole property of Soil Wizards. We shall own exclusive rights to such Submissions and may use them for any purpose without acknowledgment or compensation to you.

You may opt out of marketing communications at any time by contacting us directly or following the unsubscribe instructions in any marketing email.

 

  1. Chemical Applications & Safety

Soil Wizards applies only products that are registered, labeled, and approved for use in the State of Florida by the Florida Department of Agriculture and Consumer Services (FDACS) and the U.S. Environmental Protection Agency (EPA). All pest control applications are performed by or under the direct supervision of state-licensed pest control professionals in compliance with Florida Statutes Chapter 482.

Prior to any chemical application, our technicians will communicate relevant safety information, including re-entry intervals (the period of time that must pass before re-entering treated areas). It is your responsibility to:

  •       Disclose any known allergies, sensitivities, asthma, or other health conditions for all occupants and pets before treatment;
  •       Follow all pre- and post-treatment preparation instructions provided by our technician;
  •       Contact us immediately if you or any household member or pet experience adverse reactions following treatment.

Safety Data Sheets (SDS) for any product applied to your property are available upon request. Product labels applied during service are also available for your review.

 

  1. Disclaimers

THE WEBSITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SOIL WIZARDS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Soil Wizards does not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the Website or any Services at any time without notice. Pest control results may vary based on infestation severity, property conditions, pest species behavior, environmental factors, and client compliance with pre- and post-treatment instructions.

 

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOIL WIZARDS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (i) YOUR USE OF OR INABILITY TO USE THE WEBSITE OR SERVICES; (ii) ANY SERVICE RESULTS THAT DO NOT MEET YOUR EXPECTATIONS; OR (iii) ANY OTHER MATTERS RELATED TO THESE TERMS.

TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO SOIL WIZARDS FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS PRIOR TO THE EVENT. NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE LIABILITY FOR DEATH, PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR FRAUD.

 

  1. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Soil Wizards and its affiliates, officers, directors, employees, agents, and contractors from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your use of the Website or Services; (ii) your violation of these Terms; (iii) your violation of any third-party rights; or (iv) your failure to follow pre- or post-treatment instructions that results in injury, damage, or unsatisfactory outcomes.

 

  1. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. For any dispute arising out of or related to these Terms or our Services, you agree to submit to the personal jurisdiction of the courts located in Marion County, Florida.

Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute informally by contacting Soil Wizards directly. If the matter cannot be resolved informally within 30 days, either party may pursue their available legal remedies.

 

  1. Privacy

  1. Entire Agreement & Severability

These Terms, together with any applicable service agreement, constitute the entire agreement between you and Soil Wizards regarding the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written. If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be modified to reflect the parties’ original intent to the greatest extent possible, and all remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
